1. Scope

The following General Terms and Conditions (GTC) apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not related to their commercial or self-employed professional activity.
An entrepreneur is a natural or legal person or a legally capable partnership that, when concluding a legal transaction, acts in the exercise of its commercial or self-employed professional activity.

 

2. Contractual Partner, Conclusion of Contract, and Correction Options

The purchase contract is concluded with Adventure Bikes GmbH & Co. KG.

By placing products in our online shop, we make a binding offer to conclude a contract for these products. You can add our products to your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the ordering process. The contract is concluded when you accept the offer by clicking the order button for the products in your shopping cart. Immediately after submitting the order, you will receive an email confirmation.

 

3. Contract Language and Storage of Contract Text

The language(s) available for concluding the contract: German, English

We store the contract text in our systems; however, it is not accessible to you.

 

4. Delivery Conditions

Delivery Options

We ship products to the delivery address provided during the order process.

• We only deliver via shipping. Self-collection of the goods is unfortunately not possible.

• We do not deliver to parcel stations.

5. Payment

The following payment methods are generally available in our shop:

PayPal

To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your login details, and confirm the payment instruction. The payment transaction will be carried out immediately after placing the order. Further information can be found in the ordering process.

PayPal may offer additional payment options to registered customers based on its own criteria. We have no influence over these options; any additional payment methods offered individually are subject to your legal relationship with PayPal. Further details can be found in your PayPal account.

 

6. Warranty and Guarantees

7. Liability

We are always fully liable for claims based on damages caused by us, our legal representatives, or vicarious agents in cases of:

• Injury to life, body, or health,

• Intentional or grossly negligent breaches of duty,

• Guarantee promises, where agreed, or

• Where the scope of application of the Product Liability Act is established.

In the case of breaches of essential contractual obligations, the fulfillment of which is necessary for the proper execution of the contract and on which the contractual partner may regularly rely (cardinal obligations), caused by slight negligence by us, our legal representatives, or vicarious agents, liability is limited to the foreseeable damage that is typically expected to occur at the time of contract conclusion.

Any further claims for damages are excluded.

 

8. Dispute Resolution

We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
